Welcome to Capavi (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the website capavi.shop (the “Site”) and any purchases of products through the Site. By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

2. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised Terms on the Site with the updated Effective Date. Your continued use of the Site after the Effective Date constitutes acceptance of the revised Terms.

3. Eligibility

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to purchase on this Site. By placing an order you represent and warrant that you meet this requirement.

4. Orders, Pricing & Payment

4.1 Orders placed on the Site are subject to acceptance by Capavi. We reserve the right to refuse or cancel any order for any reason including product unavailability, pricing errors, or suspected fraud.
4.2 Prices listed on the Site are in the currency shown at checkout and may include applicable taxes where indicated. Shipping, customs, duties and other fees may apply and are the buyer’s responsibility unless otherwise stated.
4.3 Payment must be made using the payment methods displayed at checkout. You authorize us to charge your selected payment method for the total amount of the order.

5. Shipping & Returns

Our shipping and return policies are described in separate policies available on the Site (Shipping Policy, Return Policy). Those policies are incorporated into these Terms by reference.

6. Product Information & Authenticity

6.1 We sell products sourced from third-party suppliers and distributors. Unless specifically stated otherwise on the product page, Capavi is not the manufacturer of these products.
6.2 Product images and descriptions are provided for informational purposes. We strive for accuracy but do not warrant that descriptions, images, pricing, or other content on the Site are error-free. If a product you purchased is materially different from how it was described, contact support@CapaviSHOP.COM.

7. Brand & Trademark Policy; Non-Affiliation

7.1 No Affiliation. Unless expressly stated on the Site, Capavi is not affiliated with, endorsed by, or sponsored by any brand owner, manufacturer, or trademark holder referenced on the Site. Product and brand names used on the Site are the property of their respective owners and are used solely to identify the products we offer for sale.
7.2 Identification Use Only. Use of third-party trademarks, logos or brand names on the Site is for identification and comparison purposes only and does not imply any relationship, sponsorship, or endorsement by the trademark owner.
7.3 Reporting Infringement / Brand Complaints. We take intellectual property seriously and will respond quickly to legitimate complaints. If you are a rights owner and believe that content on our Site infringes your trademark or other IP rights, please send a written notice to support@CapaviSHOP.COM including:

  • Your name, contact information, and proof of identity;

  • The trademark or IP right you own and supporting documentation (registration number or other proof);

  • A clear description of the allegedly infringing material and the exact URL(s) where it appears;

  • A statement, made in good faith, that you believe the use is unauthorized; and

  • A signed statement under penalty of perjury that the information in your notice is accurate and that you are authorized to act on behalf of the rights owner.
    Upon receipt of a properly documented claim, we will investigate and may remove or disable access to the content at our discretion. We will also notify the seller and, where appropriate, provide an opportunity to cure or demonstrate authorization. For complex disputes, we may request further documentation or the involvement of counsel. We aim to respond to verified complaints promptly (usually within a reasonable number of business days).

8. Prohibited Conduct

When using the Site you agree not to:

  • Use the Site for unlawful purposes or to violate any law;

  • Post or transmit false, misleading or infringing information;

  • Attempt to interfere with the Site’s operation or access other users’ accounts;

  • Use any automated system (bots, scrapers) to access the Site without our express permission.

If you create an account, you are responsible for maintaining the confidentiality of your password and for all activity under your account. Notify us immediately of any unauthorized use.

11. Disclaimers & Limitation of Liability

11.1 No Warranty. THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPAVI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11.2 Limitation of Liability. IN NO EVENT WILL CAPAVI BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APPLICABLE PRODUCT(S). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; WHERE PROHIBITED, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

12. Indemnification

You agree to indemnify and hold Capavi and its officers, directors, employees, agents and affiliates harmless from any claim, loss, liability, costs or expense (including reasonable attorneys’ fees) arising out of your breach of these Terms, your violation of any law, or your misuse of the Site.

13. Termination

We may suspend or terminate your access to the Site at any time for violations of these Terms or for other reasons, without liability to you. Sections that by their nature should survive termination (e.g., Intellectual Property, Disclaimers, Limitations of Liability, Indemnification) will survive.

14. Governing Law & Dispute Resolution

These Terms, and any dispute arising from them, are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply therein, without regard to conflict of law rules. You agree to submit to the exclusive jurisdiction of the courts located in Vancouver, British Columbia for any disputes that cannot be resolved informally.

16. Miscellaneous

16.1 Entire Agreement. These Terms, together with any policies referenced herein, constitute the entire agreement between you and Capavi concerning the Site.
16.2 Severability. If any provision is found invalid or unenforceable, the remaining provisions will remain in effect.
16.3 Waiver. Our failure to enforce any right will not constitute a waiver.
